Atlantic City Mayor Robert Levy, who had been missing from his job for two weeks, has resigned, his lawyer said Wednesday.

The resignation was effective immediately, attorney Edwin Jacobs said.

Jacobs issued a statement saying, "The circumstances surrounding his resignation include multiple health problems but were precipitated by a pending Federal Department of Veterans Affairs investigation."

Jacobs had announced Tuesday that Levy spent about a week in a Somerset County clinic that specializes in mental health and addiction recovery before returning to the resort Thursday to recuperate at home.

After summarizing Levy's military service, which included two tours of duty in Vietnam and multiple medals, awards and citations, Jacobs added, "The pending investigation has called into question two of those awards, neither of which appear to be supported by an appropriate military order. This, in turn, creates a question as to a portion of Mr. Levy's Veterans disability benefits."

Levy has concluded that "public confidence is so eroded by these circumstances that the only responsible action is to step down."

Jacobs said that he is having discussions with the U.S. Attorney to resolve the benefits issue.

"So far as we know, no part of this Federal investigation includes any allegation that Mr. Levy in any direct or indirect way abused the electoral process or his position as Mayor or was corrupted by criminal influences," Jacobs said, adding that the probe is "narrowly focused" on isolated entries in Levy's military record and their potential effect on certain Veterans benefits "and nothing more."

The statement added that Levy resigned "with great regret and with apologies to his supporters, to the people of Atlantic City, and to his family and friends."
